Karen Painter Randall, chair of Connell Foley's Cyber Security and Data Privacy Group and co-chair of the Professional Liability Group, recently authored the article “Sixth Circuit Denies Improper Disclosure of Protected Health Information as Claim Under False Claims Act," which was posted in the May 5, 2016 issue of USLAW DigiKnow. The article discusses the court’s ruling that customers may suffer an occasional breach in spite of a health care facility’s compliance with HIPAA and HITECH, and that plaintiffs must meet a higher threshold to satisfy a claim under the False Claims Act.
