ROSELAND, N.J./February 23, 2009 -- Connell Foley Partners Thomas S. Cosma and Mitchell W. Taraschi recently won dismissal of a Complaint by a construction manager against a local board of education seeking to enforce a settlement agreement. The Court summarily denied the construction manager's request to enter judgment for over $2 million against the board; declared the settlement void and rescinded the settlement due to unilateral mistake; dismissed the construction manager's Complaint; and entered judgment directing the construction manager to return $750,000 already paid pursuant to the terms of the settlement.
