Commercial Litigation Team Led by Leo Hurley Wins Dismissal of Breach of Contract Claim at Trial

A Connell Foley LLP Commercial Litigation Team won the complete dismissal—with prejudice—of a breach of contract lawsuit alleging the firm’s client, Maverick Building Services, Inc., (“Maverick”) wrongfully terminated its contract with Complete Facilities Solutions (“CFS”).

Maverick had contracted with CFS to assist in the restoration and maintenance of the floors at the historic Newark Penn Station. After two days of trial testimony, and after a motion brought by Connell Foley on Maverick’s behalf, the Court found that CFS had failed to present any proof supporting its allegations that Maverick wrongfully terminated its contract with CFS, and that CFS’ own witness’s testimony—which Connell Foley elicited on cross-examination—showed that Maverick had cause to terminate its contract with CFS. In fact, the Connell Foley’s cross-examination was so effective that the court dismissed the case before hearing the testimony of any of Maverick’s witnesses.

The court’s decision means that CFS, which initially demanded more than $1 million to resolve these claims, will receive nothing.
