Secured: Dismissal of Middlesex County Eminent Domain Action

Richard DeAngelis, representing one of North America's largest IT solutions providers, the sole tenant at the subject property, working with counsel for the property owner, secured the dismissal of Middlesex County's eminent domain action seeking to condemn private property for an access easement. The Judge sitting in the Law Division of the Superior Court ruled that the County's eminent domain authorization was an abuse of discretion and arbitrary and capricious, finding that the primary purpose of the easement was to promote the private interests of a neighboring developer rather than for a legitimate public use. In addition to denying the County’s action to take the easement, the court also awarded attorney fees as provided under New Jersey's Eminent Domain Act.
