Falanga Wins Reversal in Third Circuit for Client Seeking Sanctions Involving Frivolous Bankruptcy Case

 

Roseland, NJ, September 30, 2008 – Connell Foley Partner Stephen V. Falanga recently won a reversal in the United States Court of Appeals for the Third Circuit on a sanctions issue involving a bankruptcy case.  Connell Foley’s client was seeking sanctions for the filing of frivolous bankruptcy proceedings.  In a precedential decision, the Third Circuit reversed the lower courts in refusing to grant sanctions and remanded to the Bankruptcy Court for a sanctions determination.  For a copy of the decision in the case, please click on the following link, In re SCHAEFER SALT RECOVERY, INC.
