Falanga Wins Reversal in Third Circuit for Client Seeking
Sanctions Involving Frivolous Bankruptcy Case

Stephen V. Falanga
recently won a reversal in the United States Court of
Appeals for the Third Circuit on a sanctions issue involving
a bankruptcy case. Connell Foley’s client was seeking
sanctions for the filing of frivolous bankruptcy
proceedings. In a precedential decision, the Third Circuit
reversed the lower courts in refusing to grant sanctions and
remanded to the Bankruptcy Court for a sanctions
