Fleder and Smith Present on Construction Strategies
in Uncertain Times

Mark L. Fleder and
Peter J. Smith, presented at Dale Group
“Business Strategies in Uncertain Times” Seminar on
May 12, 2009, at the Brooklake Country Club in Florham
Park, NJ. The seminar focused on various
applications to help industries survive the economic
downturn.
Mr. Fleder discussed the five most significant
construction project issues: bid/proposal
difficulties, poor and “unfair” contract documents,
design problems, project completion/closeout
problems, and payment difficulties from all
prospectives. Legal solutions to avoid and resolve
construction project issues when they arise were
covered at length.
Mark L. Fleder is the Co-Chair of the firm’s
Construction Law
group and a member of the
Business Litigation practice group.
Mr. Smith spoke on the current New Jersey
Construction Law and new changes under
consideration, New Jersey Municipal Mechanics Lien
Law and how it operates, New Jersey Public Works
Bond Act and Payment Bonds for public and private
projects, and the New Jersey Prompt Payment Act.
Peter J. Smith is Co-Chair of the firm’s
Construction Law group and a member of the
Alternative Dispute Resolution group.
