The health care industry has long been subject to a complex regulatory scheme and governmental scrutiny. With the recent passage of federal statutes and regulations that will continue to transform the industry, health care providers face a multitude of industry specific challenges. In today’s complex health care environment, the attorneys in Connell Foley's health care practice group offer experience and knowledge to assist clients through this maze of challenges and opportunities. Our multi-disciplined group combines the comprehensive expertise of our professionals to represent a wide cross-section of the health care industry from individual physician practitioners and large practice groups to health and hospital systems, including long term care facilities and nursing homes, as well as ambulatory, surgical and imaging centers.

The attorneys in our health care practice group are well versed and experienced in all areas of health care law, as well as corporate, real estate and zoning, land use and employment matters. This breadth of experience allows our professionals to advise clients on entity formation and corporate governance, the negotiation of buy-sell agreements, operating agreements, and shareholder agreements, as well as the drafting, review and negotiation of related commercial agreements such as real estate leases and employment contracts. In addition, we have extensive experience with respect to corporate transactions involving health care practitioners and specifically with financing, mergers and acquisitions, affiliations and joint ventures.

Our practice group attorneys are also well versed in the areas of, and frequently counsel clients on, the intricacies of federal and state fraud and abuse statutes and regulations and assist in the implementation and development of compliance programs for clients.

Members of our group assist with medical staff relationships involving credentialing, privileges and peer review, and represent medical providers before professional review boards. We also counsel practitioners on related issues involving patient treatment concerns as well as consent requirements and policy guidelines.

When needed, our attorneys and litigators counsel clients on contract and business disputes, and oversee administrative and civil litigation including professional liability claims and employment related disputes.

Examples of our comprehensive representation to clients include general counsel to numerous medical practices in a wide variety of sub-specialties, representation of an ambulatory surgical facility from formation through operation, and counseling of clients on regulatory matters including the Patient Protection and Affordable Care Act (PPACA), the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Health Information for Economic and Clinical Health (HITECH) Act, anti-kick back and anti-referral statutes and regulations.
